BY THE COURT: The opinion filed January 4, 2013, is modified as follows: In the second paragraph on page 7, the sentence that reads The murder weapon was never found, although a different semiautomatic handgun was seized by police when they arrested Peters and searched his home is deleted. The following sentence is inserted in its place: The murder weapon was never found, although a different semiautomatic handgun was seized by police when they arrested Coley and searched his home. The modification does not affect the judgment.
