Joey Reuben Watson appeals from the judgment entered following his no contest plea to battery by a prisoner in violation of Penal Code section 4501.5.1 Section 4501.5 provides that a "person confined in a state prison" is guilty of a felony if he "commits a battery upon the person of any individual who is not himself a person confined therein . . . ." Appellant admitted one prior serious or violent felony conviction within the meaning of California's "Three Strikes" law. (
