IN THE COURT OF APPEAL OF THE STATE OF CALIFORNIA SIXTH APPELLATE DISTRICT

BRIAN REID, Plaintiff and Appellant, v. GOOGLE, INC., Defendant and Respondent. THE COURT:

H029602 (Santa Clara County Super. Ct. No. CV023646) ORDER MODIFYING OPINION CHANGE IN THE JUDGMENT

It is ordered that the opinion filed herein on October 4, 2007, be modified as follows: 1. On page 25, line nine, the word "would" is changed to "could" so the sentence reads: We conclude that Reid produced sufficient evidence that Google's reasons for terminating him were untrue or pretextual, and that Google acted with discriminatory motive such that a factfinder could conclude Google engaged in age discrimination. 2. At the end of the last paragraph on page 25, after the sentence ending "causes of action is reversed" add the following sentence: Reid is awarded costs on appeal.

This modification changes the judgment.
