THE COURT: It is ordered that the opinion filed herein on October 24, 2011, be modified as follows: On page 5, in the second to the last sentence of the first full paragraph, replace the word "seizure" with the word "search," so that the sentence states: "But we cannot hold the search proper." There is no change in the judgment.
