This case is before the Court for review of the decision of the Second District Court of Appeal in Frosti v. Creel, 943 So. 2d 1023 (Fla. 2d DCA 2006). The district court certified that its decision is in direct conflict with the decision of the Fifth District Court of Appeal in Mills v. Martinez, 909 So. 2d 340, 344 (Fla. 5th DCA 2005). The conflict issue is whether a motion for attorney fees and costs predicated upon a rejected proposal for settlement must be denied where the proposal was filed in the trial court prior to entry of judgment. We have jurisdiction. See art. V,
