Devon Neighborhood Ass`n, 33 So. 3d 48 (Fla. 4th DCA 2009), on the ground that it expressly and directly conflicts with the decisions of this Court in Old Port Cove Holdings, Inc. v. Old Port Cove Condominium Ass`n One, Inc. , 986 So. 2d 1279 (Fla. 2008), and Metropolitan Dade County v. Chase Federal Housing Corp., 737 So. 2d 494 (Fla. 1999). FIGA also asserts that the decision of the Fourth District expressly and directly conflicts with this Court`s decision in Menendez v. Progressive Express Insurance Co., 35 So. 3d 873 (Fla. 2010), which was issued

after the Fourth District`s decision below. We have jurisdiction. See art. V,
