Robert Shannon Walker, II, was convicted of the 2003 first-degree murder, kidnapping, and aggravated battery of David "Opie" Hamman and sentenced to death. On direct appeal, this Court affirmed Walkers convictions and death sentence. Walker v. State, 957 So. 2d 560, 570 (Fla. 2007). Walker later filed a motion for postconviction relief pursuant to Florida Rule of Criminal Procedure 3.851. Walker appeals from the postconviction courts denial of his guilt -phase claims, and the State cross-appeals the postconviction courts grant of a new penalty phase.1
