The Galasinaos crossappeal from the portions of the final judgment entered in favor of Macanas. Upon careful review of the record and the briefs submitted by the parties and having given due consideration to the arguments made and the issues raised by the parties, IT IS HEREBY ORDERED that the circuit court's judgment is hereby affirmed for the following reasons: 1) the circuit court properly concluded that Macanas could not bring a civil action for the $40,000 held in escrow and properly ordered the
