SUMMARY DISPOSITION ORDER Upon carefully reviewing the record and the briefs submitted by the parties and having given due consideration to the arguments advanced and the issues raised by the parties, we hold that the circuit court did not err in denying Ronald Gomes's (Gomes) Hawai#i Rules of Penal Procedure (HRPP) Rule 35 motion to correct or reduce his sentence issued July 20, 1999 inasmuch as: (1) the circuit court did not err in allowing Gomes to be convicted of both sexual assault in the first degree in violation of HRS
