ORDER AMENDING MEMORANDUM OPINION

The memorandum opinion, filed on May 10, 2000, is hereby amended as follows: On page 15, the date "June 24, 1994" in the last line of the last paragraph of the opinion is deleted and replaced with the date "June 24, 1998," so that the paragraph reads:
Accordingly, we affirm the circuit court's June 24, 1998 Amended Findings and Conclusions and the March 30, 1994 Judgment that was reinstated and given full force and effect by the June 24, 1998 Amended Findings and Conclusions.

Chief Judge James S. Burns is sitting in place of former Associate Judge Simeon R. Acoba, Jr., who was a member of the panel on this appeal but who was appointed to the Hawai #i Supreme Court at the close of business on May 19, 2000.
