Fourth District Docket No. 4-10-0905 May 11, 2011 July 13, 2011 The trial court erred in entering summary judgment for plaintiff union on its petition to compel arbitration of a controversy arising from defendant city's failure to fulfill its promise to increase the salary of a union member who transferred to a nonunion position with the city as part of an oral agreement between the union and the city requiring the union member to end her pending lawsuit against the city, since the employee was no longer a part of the bargaining unit and section 8 of the Public Labor Relations Act did not require arbitration of the controversy.
