IN THE SUPREME COURT OF THE STATE OF ILLINOIS

THE PEOPLE OF THE STATE OF ILLINOIS, Appellant, v. JAMYRA E. BEW, Appellee. Opinion filed March 20, 2008.

JUSTICE GARMAN delivered the judgment of the court, with opinion. Chief Justice Thomas and Justices Freeman, Fitzgerald, Kilbride, Karmeier, and Burke concurred in the judgment and opinion.

OPINION Defendant, Jamyra E. Bew, was convicted in the circuit court of Will County of unlawful possession of cannabis with intent to deliver in violation of section 5(g) of the Cannabis Control Act (720 ILCS 550/5(g) (West 2002)) and sentenced to six years in prison. Defendant appealed her conviction, claiming that trial counsel was ineffective for failing to file a motion to suppress evidence. The appellate court, relying on People v. Cox, 202 Ill. 2d 462 (2002), reversed the conviction and remanded the cause for a new trial. People v. Bew, No. 3
