JUSTICE FITZGERALD delivered the opinion of the court:

Following a jury trial in the Cook County circuit court, thedefendant, Edward Graham, was convicted on three counts of firstdegree murder. The defendant waived his right to a sentencing-phase jury, and the trial court found him eligible for the deathpenalty. The court then found no mitigating circumstancessufficient to preclude the death penalty and sentenced thedefendant to death. That sentence has been stayed pending directreview by this court. Ill. Const. 1970, art. VI,
