SUPREME COURT OF LOUISIANA No. 01-C-0145 Jimmy Shay RICHARD VERSUS MIKE HOOKS, INC. ON WRIT OF CERTIORARI TO THE COURT OF APPEAL THIRD CIRCUIT, PARISH OF CALCASIEU CALOGERO, Chief Justice* We granted this writ to determine if a tacker/welder's helper, who was injured while working for defendant, Mike Hooks, Inc., is a sea-based maritime employee entitled to Jones Act protection or a land-based worker who happens to spend a portion of his time working on Hooks's vessels. After reviewing the record, we find the latter to be correct, and hold that plaintiff does not qualify as a seaman for purposes of the Jones Act, 46 U.S.C.
