Traylor, J., retired. Justice Traylor retired after oral argument and did not participate in the deliberation of this casefollowing his date of retirement, May 31, 2009.
For the reasons stated herein, the judgment of the court ofappeals is reversed, the trial court judgment denying defendants'Exceptions of Improper Venue and Prescription is reinstated, andthe case is remanded to the trial court for further proceedings.REVERSED AND REMANDED; TRIAL COURT JUDGMENT REINSTATED.
