I agree with the court's vote that this application for reconsideration should be "not considered" under Rule 9, Section 6 of the Supreme Court Rules. However, I additionally concur to note the action on defendants' original writ was motivated by our inability to determine, in the pre-trial posture of this case, and with the information filed in our court, whether plaintiffs raise issues of property law alone, or have combined issues of property law and personal injury.
