The Appellant, Dorine Austin, appeals the district court’s ruling that her
claim against the Appellee, Lakeland Medical Center, prescribed pursuant to the
Louisiana Medical Malpractice Act.
Mrs. Austin filed a petition for damages against Dr. Sottiurai and Lakeland
Medical Center at the same time.   Dr. Sottiurai, filed an exception of prescription,
which was granted by the district court. Ms. Austin appealed that decision, and the
district court’s judgment was affirmed by this court on appeal.
Subsequently, Lakeland filed an exception of prescription. The district court
also granted this exception from which Ms. Austin filed the instant appeal.
Considering that the above numbered and entitled matter arises out of the
same facts and circumstances, and this appeal raises the same issue of prescription
this Court previously adjudicated in the matter of Dorine Austin vs. Lakeland
Medical  Center  and  Dr.  Vikrom  Sottiurai,  05-0877  (La.App.  4  Cir.  3/22/06),
wherein we determined that Dorine Austin’s claims against Dr. Vikrom Sottiurai
had  prescribed;  Dorine  Austin’s  claims  against  Lakeland  Medical  Center  are
deemed prescribed, and the judgment of the district court is hereby affirmed.
