KNOLL, J.-concurs with reasons.
State: Louisiana
Court: Supreme Court
Docket No: KNOLL,
Case Date: 01/01/1998
Preview:SUPREME COURT OF LOUISIANA 97-C-1932

TAMMIE JO BOYKIN, ET AL. versus LOUISIANA TRANSPORT COMPANY, INC., ET AL.

KNOLL, J., concurring. I concur in the above captioned opinion. In my view, the tortfeasor's running the red light was the sole cause of the accident. There was no record evidence to support the plaintiff's contention that the timing of the light deprived her of the opportunity to keep a lookout. Therefore, discussion of DOTD's duty with regard to the timing of the light is not triggered. I find that regardless of the timing of the light, the inattentive motorist was an overriding and intervening cause of the plaintiff's injuries.
