CIVIL NO. 02-128-P-H

ORDER AFFIRMING RECOMMENDED DECISION OF THE MAGISTRATE JUDGE

The United States Magistrate Judge filed with the court on December 20, 2002, with copies to the parties, her Recommended Decision on Defendant's Motion for Summary Judgment. The time within which to file objections expired on January 10, 2003, and no objections have been filed. The Magistrate Judge notified the parties that failure to object would waive their right to de novo review and appeal. It is therefore ORDERED that the Recommended Decision of the Magistrate Judge is hereby ADOPTED. Summary judgment is GRANTED to the defendant on the plaintiff's claims under the Americans with Disabilities Act and the Maine Human Rights Act. With regard to the plaintiff's denial of leave claims, judgment is GRANTED to the defendant on the plaintiff's Maine Family and Medical Leave Act claim; summary judgment is DENIED to the defendant on the plaintiff's federal Family and Medical Leave Act claim. SO ORDERED. DATED: JANUARY 14, 2003
