REPORT AND RECOMMENDED DECISION1

This Supplemental Security Income ("SSI") appeal raises the question whether substantial evidence supports the commissioner's determination that the plaintiff, who alleges that he is disabled by anxiety, a learning disorder and depression, is capable of returning to past relevant work as a flagger. I recommend that the decision of the commissioner be vacated and the case remanded for further development. In accordance with the commissioner's sequential evaluation process, 20 C.F.R.
