In this case, plaintiff Bell Atlantic-Maryland, Inc. ("Bell Atlantic")1 has challenged the validity of defendant Prince George's County ("the County") ordinance CB-98-1998 ("the ordinance") which seeks to regulate the use of County rights of way by telecommunications companies. Bell Atlantic

filed its complaint in 1998, asserting a variety of federal and state constitutional and statutory claims. In its 1999
