(Compl. at 1.) The United States of America1 has moved to dismiss the complaint for lack of subject matter jurisdiction pursuant to Federal Rule of Civil Procedure 12(b)(1). Because Mr. Boone has failed to exhaust his administrative remedies, as required by the Federal Tort Claims Act ("FTCA"), the government's motion will be granted.
