MEMORANDUM Presently pending before this court is Defendant and Third Party Plaintiff Tube City Inc.'s ("Tube City") request for a Rule 54 certification of this court's May 4, 1999 Order granting Plaintiff Bituminous Casualty Corporation's ("Bituminous") motion for summary judgment and denying Tube City's motion for summary judgment. For the reasons stated

below, Tube City's motion for a Rule 54 certification will be denied. INTRODUCTION On July 30, 1997, Estalena C. Thompson filed suit against several defendants, including Tube City and Rway Services ("Rway"), alleging that her husband was killed at Bethlehem Steel by molten lead which escaped from a crane ladle. On October 10, 1997, Bituminous, Rway's insurer, filed a declaratory judgment action against Rway, Tube City, and Mrs. Thompson, contending 1

that because of certain exclusions, Rway's policy did not provide coverage either to Rway for the claims and allegations contained in Mrs. Thompson's Complaint or to Tube City for its defense and indemnification. Compl.
