ORDER This case presents medicalmalpractice claims arising out of the diagnosis, treatment and subsequent death of Plaintiff's decedent, her former husband, Bruce Albert Bodine. At the time of his death in 1998 and immediately before, Mr. and Mrs. Bodine were domiciliaries of Maryland. Plaintiff has moved to Virginia and has brought this case in this court on the basis of diversity of citizenship. Subject matter jurisdiction over Plaintiff's individual claim for wrongful death is reasonably clear; the lack of jurisdiction over the survival claim she asserts as the personal representative of Mr. Bodine's estate is equally clear.
