MEMORANDUM Plaintiff Carrie Crawford, a member of the Maryland bar representing herself, filed suit against Societe Air France ("Air France") and IT Sources, LLC ("IT"), seeking a refund of $4,182.00 claiming that she paid $6,273.00 to IT for three airplane tickets and only used one. Now pending are motions for summary judgment and sanctions by Air France, and crossmotions filed by Crawford. For the reasons that follow, the defendant's motions will be granted and the plaintiff's motions will be denied. The evidence in this shows that: (1) Air France received $1,936.20 on October 15, 2006 for a single ticket (No. 057-7789791951) issued to Crawford by Skybird Travel and Tours, an authorized agent of Air France, on October 12, 2006, and used by Crawford in August 2007, and (2) that IT, which apparently received $6,273.00 from Crawford for three tickets, is not an agent of Air France. It appears that IT may have received funds from the plaintiff for the purchase of three tickets to the Democratic Republic of Congo, but provided only one, through Skybird. Crawford cancelled the other two tickets and requested IT to refund the remaining $4,182.00, but she did not receive a refund, although she did receive "airfare service" from IT in August 2007 worth approximately $2,400.00. She has sued both Air France and IT for the full $4,182.00. Crawford has offered absolutely no evidence in support of her claims against Air France, nor has she offered any substantial justification for her failure to appear - twice - at scheduled

depositions. Accordingly, the defendant's motion for summary judgment will be granted, as will its motion for sanctions, to the extent of requiring Crawford to pay for the costs of the court reporter on November 11 and 21, 2008, and the cost of defense counsel's time in attending the scheduled depositions. Counsel shall submit an affidavit of these costs to the court, with a copy to Crawford, to be paid by Crawford within 10 days. As to defendant IT Sources, LLC, it appears that service was effected on August 22, 2008 but no answer has been filed nor any further action taken regarding IT. The plaintiff will be required to advise the court whether and how she intends to proceed; in the alternative, the claim against IT will be dismissed without prejudice. A separate Order follows.

ORDER For the reasons stated in the accompanying Memorandum, it is hereby ORDERED that: 1. the motion for summary judgment filed by Air France (docket entry no. 19) is Granted; 2. the motion for sanctions filed by Air France (docket entry no. 20) is Granted, to the extent that the plaintiff shall pay deposition costs as stated in the Memorandum upon filing of an appropriate affidavit by defense counsel; 3. the plaintiff's cross-motions are Denied; and 4. no later than February 20, 2009, Crawford shall advise the court whether and how she intends to proceed against IT; in the alternative, this claim will be dismissed without prejudice.
