ORDER Upon consideration of the Plaintiff's Motion for Partial Summary Judgment (Paper No. 23); the Defendants' Cross-Motion for Summary Judgment (Paper No. 27), the Motion to Exclude Evidence Pursuant to Rule 27(C) of the Federal Rules of Civil Procedure (Paper No. 35), the Oppositions and Replies, and the argument of counsel heard on June 2, 2008, it is, for the reasons set forth in the accompanying Memorandum Opinion, this 12th day of September, 2008, by the United States District Court for the District of Maryland, ORDERED, that the Motion to Exclude Evidence Pursuant to Rule 27(C) of the Federal Rules of Civil Procedure (Paper No. 35) is DENIED; and it is further ORDERED, that the Plaintiff's Motion for Partial Summary Judgment (Paper No. 23) is DENIED; and it is further ORDERED, that the Defendants' Cross-Motion for Summary Judgment (Paper No. 27) is GRANTED; and it is further

ORDERED, that JUDGMENT FOR COSTS be entered in favor of the Defendants; and it is further ORDERED, that the Clerk of this Court is directed to CLOSE THE CASE.
