Upon consideration of the Defendant's Motion for Summary Judgment [Paper No. 32], the response in opposition thereto, the parties' correspondence and memoranda concerning jurisdiction [Paper No. 40, 41, 43 & 44], the arguments, evidence and testimony presented to the undersigned at a hearing held on April 23, 2007, and for the reasons stated in the accompanying opinion, it is this 31st day of July, 2007, by the United States District Court for the District of Maryland, ORDERED, that Plaintiff's complaint is DISMISSED WITHOUT PREJUDICE for lack of jurisdiction; and it is further ORDERED, that the Clerk of the Court is DIRECTED to close the case.
