Plaintiff has filed a motion to reconsider this court's order of July 8, 2008. Defendant has opposed the motion and has filed its own motion requesting that I amend the July 8, 2008 order to award defendant attorneys' fees in the amount of $6,660 for fees expended in connection with this dispute. I remain of the view that my July 8, 2008 order granting defendant's motion to compel was correct. As to the question of attorneys' fees, I am persuaded that I should award some fees in favor of defendant against plaintiff. However, I will substantially reduce the fee award requested by defendant to $2,000. Plaintiff's failure to pay that amount on or before September 3, 2008 will result in dismissal of this action.
