ORDER For the reasons stated in the accompanying memorandum, it is, this 14th day of July 2003 ORDERED that 1. Defendant's motion for summary judgment on Count I and to dismiss Count II of the complaint is granted in part and denied in part; 2. Summary judgment is granted in favor of Defendant on Count I; 3. Count II is dismissed; and 4. Plaintiff is granted leave to amend Count II of his complaint and shall file such an amendment on or before July 29, 2003.
