MEMORANDUM The plaintiffs in this case bring constitutional claims against the Mayor and City Council of Baltimore ("City"), the Baltimore City Police Department ("BPD"), collectively "the City defendants,"1 and current and former wardens2 ("Wardens") of the Central Booking and Intake Center ("CBIC"), collectively "the State defendants,"3 for alleged mistreatment of people arrested and taken to CBIC for booking and processing. The plaintiffs allege two general areas of unconstitutional treatment of arrestees while at CBIC: strip searches and "over detention". Three motions are now pending before the court: (1) the City defendants' motion to dismiss the third amended complaint; (2) the State defendants' motion to dismiss the third amended complaint or alternatively for summary judgment; and (3) the plaintiffs' motion to deny the State defendants' motion for summary judgment or alternatively to permit discovery.
