State: Maryland
Court: Maryland District Court
Case Date: 03/19/2012
Preview:IN THE UNITED STATES DISTRICT COURT FOR THE DISTRICT OF MARYLAND ROBERT JEFFREY SHRINER, et al., Plaintiffs, v. ANNAPOLIS CITY POLICE DEPARTMENT, et al., Defendants. MEMORANDUM By Order issued March 2, 2012 (ECF 25) ("Discovery Order"), in response to plaintiffs' "Motion for Leave to Conduct Limited Discovery Prior to the Time Specified in Rule 26(d)" (ECF 23), I directed defendants Bembe Beach, LLC ("Bembe") and the Maryland Transportation Authority Police Department ("MdTAP") to provide specified limited preliminary discovery to plaintiffs. In particular, I directed Bembe and the MdTAP to provide plaintiffs with a variety of personal identifying information and contact information as to other defendants, who have not yet been served and are former employees of Bembe or the MdTAP, so as to enable plaintiffs to effect service upon the unserved defendants. I also authorized any party to move to rescind or modify the Discovery Order as improvidently granted, and provided that, if such a motion was filed, the Discovery Order would be stayed automatically until resolution of the motion. The MdTAP has filed an "Opposition to the Motion for Leave to Conduct Limited Discovery and/or Request for Striking of Order as Improvidently Granted" ("Opposition") (ECF 26), arguing that the information that plaintiffs seek is "confidential information protected by state and federal law," and thus should be exempt from disclosure to plaintiffs.
