ORDER For the reasons stated in the accompanying Memorandum, it is hereby ORDERED that: (1) the defendant's motion for summary judgment (docket number 37) is denied in part as to the failure to promote claims dealing with the failure to promote to shift B and shift C and the retaliation claim for loss of overtime pay; (2) the defendant's motion for summary judgment (docket number 37) is granted in part as to the failure to promote claim dealing with the failure to promote to shift A and plaintiff's retaliation claim for riding in a fire engine in unsafe equipment; and (3) the Clerk shall send copies of this Order and the accompanying Memorandum to counsel of record.
