That State Defendants' Motion to Dismiss Amended Complaint [12-1] be, and the same hereby is, DENIED AS MOOT, and State Defendants' Motion for Summary Judgment [12-2] be, and the same hereby is, GRANTED as to Counts I through VIII; 4. 5. That State Defendants' Motion to Strike [12-3] is DENIED; That County Defendants' Motion to Dismiss Amended Complaint [13-1] be, and the same hereby is, GRANTED as to Counts IX and XII, and County Defendants' Motion for Summary Judgment [13-2] be, and the same hereby is, GRANTED as to Counts X and XI; 6. That Plaintiff's remaining state claims in Counts XIII to XIX are DISMISSED;

That Plaintiff's Motion for Continuance to Permit Discovery [14-1] be, and the same hereby is, DENIED, while Plaintiff's Motion to Excuse Late Filing [17-1] be, and the same hereby is, GRANTED;
