For the reasons stated in the accompanying memorandum to counsel, it is, this 3rd day of January 2007 ORDERED 1. Plaintiff's motion for summary judgment is denied; 2. Defendant's motion for summary judgment is granted in part and denied in part; 3. Defendant's motion is denied as to count I relating to the 121 buses that were sold to Miami Metro Dade, Maryland MTA, and WMATA; 4. Defendant's motion is granted as to counts II and III and judgment is entered in favor of defendant against plaintiff as to those counts; and 4. Defendant's motion is denied as to count IV.
