COURT OF APPEALS

PEOPLE OF THE STATE OF MICHIGAN, Plaintiff-Appellee, v

UNPUBLISHED March 25, 1997

No. 188097 Grand Traverse Circuit Court LC No. 91-005776-FH

JEANETTE LAMB, Defendant-Appellant.

Before: D.F. Walsh,* P.J., and R.P. Griffin** and W.P. Cynar,* JJ. MEMORANDUM. Defendant pleaded guilty to violating probation on her underlying conviction of embezzlement by agent, MCL 750.174; MSA 28.371, and was sentenced to four to ten years' imprisonment. She appeals as of right. We affirm. This case has been decided without oral argument pursuant to MCR 7.214(A). The trial court did not abuse its discretion in sentencing defendant. Considering that this probation violation resulted from defendant's commission of her third and largest theft felony, the sentence imposed does not violate the principle of proportionality. People v Milbourn, 435 Mich 630; 461 NW2d 1 (1990). Affirmed.
