COURT OF APPEALS

PEOPLE OF THE STATE OF MICHIGAN, Plaintiff-Appellee, v SPIRLIN MOORE, Defendant-Appellant.

UNPUBLISHED October 4, 1996

No. 187022 LC No. 94-067811-FC

Before: J.H. Gillis, P.J., and G.S. Allen and J.B. Sullivan, JJ.* MEMORANDUM. Defendant pleaded nolo contendere to second-degree criminal sexual conduct, MCL 750.520c(1)(f); MSA 28.788(3)(1)(f), and was sentenced to ten to fifteen years' imprisonment. He appeals as of right. We affirm. This case has been decided without oral argument pursuant to MCR 7.214(A). Having reviewed the record, we find no support for defendant's claim that he was induced to enter his plea as a consequence of receiving ineffective assistance of counsel. People v Bordash, 208 Mich App 1, 2; 527 NW2d 17 (1994); In re Oakland County Prosecutor, 191 Mich App 113, 120; 477 NW2d 455 (1991). Nor has defendant provided us with any such support. Accordingly, we are unpersuaded that the case should be remanded to give defendant an opportunity to try to create a supportive evidentiary record. Affirmed. /s/ John H. Gillis /s/ Glenn S. Allen, Jr. /s/ Joseph B. Sullivan

*Former Court of Appeals judges, sitting on the Court of Appeals by assignment pursuant to Administrative Order 1996-3.
