Affirmed. Considered and decided by the court en banc without oral argument. OPINION DIETZEN, Justice. Following a jury trial, appellant Derrick Delmar Brocks was convicted of firstdegree murder for the August 17, 1996, shooting death of James Nunn. We affirmed Brockss conviction on direct appeal. State v. Brocks, 587 N.W.2d 37, 39 (Minn. 1998).
