BEFORE SULLIVAN, P.J., SMITH AND MILLS, JJ. SMITH, JUSTICE, FOR THE COURT:

On March 15, 1995, Norman Kent Adams was indicted in the Pike County Circuit Court for the following charges: (1) conspiracy to commit the crime of unlawful possession of cocaine with intent to distribute within 1500 feet of a church building, and (2) unlawful possession of cocaine with intent to distribute within 1500 feet of a church building. Frank Dawson, Jr. and Donna L. Ginn were indicted along with Adams. Adams was indicted as a habitual offender, having had two prior felonies of separate charges arising out of different times and for which he was sentenced to prison terms of a year or more. Adams initially pled not guilty to both charges. However, on April 5, 1995, Adams pled guilty to the amended charge of conspiracy to commit the crime of unlawful possession of cocaine with intent to distribute.
