Patsy Jean Anderson, as personal representative of
the estate of Marie Sanders, deceased, the plaintiff, cross-
appellant and respondent, has filed herein a petition for
rehearing. Leo B. Baker, defendant, cross-appellant, and
respondent has filed objections thereto. The Court has
examined and considered the same.
IT IS ORDERED:
1. The final paragraph of the majority opinion
appearing on page 280 of 39 State Reporter, is stricken and
the following paragraph substituted therefor:
"Reversed and remanded to the District Court for entry. of judgment for plaintiff and cross-appellant Anderson in the principal sum of $26,182.35 plus accrued interest on the two certificates of deposit and savings account from July 30, 1978 to November 30, 1978, to bo calculated by the District Court, together gith interest at the statutory rate on the foregoing total sum from November 30,

to date of judgment, and costs."
