Before the Court are the Findings and Recommendations of United States Magistrate Judge Jeremiah C. Lynch. No objection was timely filed to Judge Lynch's recommendation that Plaintiff Sandvig's Complaint be dismissed for failure to state a claim upon which relief can be granted.
The Court reviews the Findings and Recommendations of a United States Magistrate Judge for clear error. McDonnell Douglas Corp. v. Commodore Bus. Mach., Inc., 656 F.2d 1309, 1313 (9th Cir. 1981). Clear error is present only ifthe Court is left with a "definite and firm conviction that a mistake has been committed." United States v. Syrax, 235 F.3d 422, 427 (9th Cir. 2000).
After a review of Judge Lynch's Findings and Recommendations, I find no
clear error. Plaintiff challenges his conviction with a civil action filed under 18
U.S.C.
