THE STATE OF NEW HAMPSHIRE
SUPREME COURT
In Case No. 98-461, State of New Hampshire v. Paul Hill, the court on October 23, 2001, made the following order:
On July 3, 2001, the State reported an error in the slip opinion dated July 2, 2001, in this matter. On July 18, 2001, the New Hampshire Civil Liberties Union filed a motion to correct listing of counsel.
With respect to these two matters, the court orders that the slip opinion dated July 2, 2001, shall be modified as follows:
1. On page 1 of the slip opinion, the listing for counsel that states: "Joshua L. Gordon, of Concord, and Barbara A. Bradshaw, of Durham, for Patricia Welsh, as amicus curiae" is deleted and replaced with the following:
Joshua L. Gordon, of Concord, and Barbara A. Bradshaw, of Durham, on behalf of the New Hampshire Civil Liberties Union, for Patricia Welsh, as amicus curiae.
2. On page 8 of the slip opinion, the indented quotation that appears at the top of the page and which begins with "[After the defendant is] booked" and concludes with "behind the wheel." is deleted and replaced with the following indented quotation:
[After the defendant is] booked, he's still lying. Not once does he say, geeze, man, I wasn't behind the wheel. Geez. Go check with Dawn. I wasn't behind the wheel. Well, its right here. He's saying, oh, no. This form which is going to be filled out, which, you know, I could make it all go away, I just realized I wasn't the guy behind the wheel. He didn't tell him that, because he knows he was behind the wheel.
Brock, C.J., and Broderick, Nadeau and Dalianis, JJ., concurred.
