The Plaintiff (hereinafter "Village Board") has commenced this declaratory judgment action against the Defendant Kelly M. Allen (hereinafter "Allen"), seeking a declaration that the Defendant is ineligible to remain in his current office as Mayor of the Village of Sodus, New York.
