Plaintiff Abraham Jallow commenced this action seeking to recover damages for personal injuries sustained during an accident that took place during the renovation of the condominium complex owned by Kew Gardens Hills Apartment Owners (hereinafter referred to as "Kew Gardens"). Plaintiff sues, inter alia, Kew Gardens and the general contractor on the project, Dean Builders Group Inc. (hereinafter referred to as "Dean Builders"). Plaintiff now moves for partial summary judgment on liability, based upon the alleged violation of Labor Law
