In July 2005, the plaintiff commenced the instant action t o recover damages

for injuries he allegedly sustained in the accident. Specifically, he claims t o have suffered a herniated disc, sprains and strains of t h e lumbosacral and cervical spine, severe contusions t o both hips and various psychological damages. The defendants n o w move for summary judgment dismissing the complaint on t h e ground that the plaintiff did not meet the threshold "serious injury" requirement of Insurance Law 951 02(d), necessary t o sustain this action. The defendants' motion is granted.

To prevail on a motion for summary judgment, the moving party must
produce evidentiary proof in admissible form sufficient t o show the absence o f any material issue of fact and the right t o judgment as a matter o f law.
