Appeal from a judgment of the City Court of Yonkers, Westchester County (Robert C. Cerrato, J.), entered March 5, 2004. The judgment, after a nonjury trial, awarded plaintiff the principal sum of $300.
Judgment reversed without costs and action dismissed.
Plaintiff instituted this small claims action for damages as a result of defendant's failure to move his furniture and personal effects from his apartment in the Bronx to a home in Poquague, New York within one day. The testimony at trial established that the move was delayed due to plaintiff's failure to pack his own items as had been previously agreed.
