NAKIA NICKERSON No. 458PA10 (FILED 7 OCTOBER 2011) Possession of stolen property -- unauthorized use of a motor vehicle -- not lesser included offense -- no jury instruction required The trial court did not err in a felony possession of stolen goods case by denying defendant's request for a jury instruction on the unauthorized use of a motor vehicle. Unauthorized use of a motor vehicle is not a lesser included offense of possession of stolen goods because the crime of unauthorized use of a motor vehicle contains at least one essential element not present in the crime of possession of stolen goods. The decision of the Court of Appeals was reversed.
