Capital City Foods, Inc. appealed a Job Service decision granting unemployment benefits to Dennis Lang. Capital City claimed misconduct justified Lang's discharge from employment and also disqualified him from benefits. The district court affirmed the Job Service decision and so do we. Affirmed. NDRAppP 35.1(a)(5).
