Case Date: 09/15/2004

City of Wahpeton v. TimmermanNos. 20040075, 20040076 & 20040077

Per Curiam.

[¶1] Pearl R. Timmerman appealed from convictions for driving without a license and resisting arrest and from subsequent orders denying her motions to dismiss the charges and withdraw her guilty pleas. The district court denied Timmerman's motion to withdraw her guilty pleas holding the pleas were entered voluntarily. The district court rejected her allegations of denial of her constitutional right to drive, denial of effective assistance of counsel, denial of due process, and lack of jurisdiction. The district court held her guilty pleas effectively waived all non-jurisdictional issues, the evidence presented at the hearing sufficiently established the jurisdictional basis, and her remaining allegations were frivolous and meritless.

[¶2] We summarily affirm under N.D.R.App.P. 35.1(a)(1), (2) and (4).
