Albert and Elsie Hibl (Hibls) appeal from a decision by the Southwest Judicial District Court granting American State Bank and Trust of Dickinson's (ASB's) motion for summary judgment after finding that the Hibls had failed to state a claim upon which relief could be granted. We affirm the judgment of the lower court pursuant to Rule 35.1(a)(6), N.D.R.App.P.
