State: North Dakota
Docket No: 960268
Case Date: 02/14/1997

Hulstrand Const. v. James Cape & Sons, Co., et al.Civil No. 960268

Per Curiam.

[¶1] James Cape & Sons Co. appeals from the district court's judgment affirming a highway construction arbitration award ordering Cape to pay Hulstrand Construction for its subcontract work and dismissing Cape's counterclaim for damages. Under Rule 35.1, N.D.R.App.P., we summarily affirm the district court's judgment affirming the arbitration board's decision. The standard of review for vacating an arbitration award is "completely irrational." Byrons Const. Co. v. Dep't of Transp., 463 N.W.2d 660, 662 (N.D. 1990) (stating "[a]n arbitration decision will be vacated only if it is completely irrational"); cf. Rule 35.1(a)(2), N.D.R.App.P.[¶2]Gerald W.
